These Terms of Service ("Terms") govern access to and use of the ikWik website, applications, and services (collectively, the "Platform"). The Platform is operated by ikWik Services Limited Company, 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, United States.
By creating an account, clicking an acceptance control, or accessing or using the Platform, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Platform.
ikWik is a technology marketplace that enables Senders, Travelers, recipients, pickup-point operators, and other users to find, communicate with, and arrange crowdshipping activities. ikWik is not a carrier, freight forwarder, customs broker, logistics provider, insurer, or seller of goods. ikWik does not take possession, custody, title, or control of packages and does not direct or supervise any Traveler, Sender, recipient, route, handover, or delivery.
Users independently decide whether to use, accept, decline, or complete a transaction. ikWik does not guarantee any user’s identity, conduct, availability, legality, reliability, qualifications, route, arrival time, package condition, delivery outcome, or the accuracy of user-provided information. Users are solely responsible for their interactions, communications, meetings, handovers, shipments, and decisions. Exercise appropriate caution and do not share information or meet others in an unsafe manner.
You must be at least 18 years old and legally able to enter into a binding agreement to use the Platform. You must provide complete, accurate, current information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.
You may not create accounts for another person without authority, impersonate another person, bypass security controls, or use the Platform for unlawful, fraudulent, abusive, or deceptive purposes.
ikWik may require identity verification, additional information, payment verification, or other checks before allowing access to particular features, especially for Travelers. You authorize ikWik and its service providers to verify information you provide and to conduct fraud-prevention, sanctions, compliance, and other legally required screening where appropriate. We may refuse, suspend, restrict, delay, cancel, or report an activity where we reasonably believe it presents safety, fraud, sanctions, legal, or policy risk.
Senders are solely responsible for every package they offer or provide for transport. Before a handover, a Sender must accurately and completely declare the package contents, quantity, weight, dimensions, value, condition, ownership, pickup and destination details, special handling needs, and any information required for lawful transport or customs clearance. A Sender represents and warrants that it owns the package or has all authority and permissions needed to ship it.
Travelers may inspect a package before accepting or carrying it and may refuse any package for any lawful reason. A Traveler must not knowingly accept a package that is undeclared, suspicious, damaged, prohibited, or unlawful. Neither ikWik nor a Traveler is responsible for a Sender’s inaccurate, incomplete, misleading, or false declaration.
You must not list, send, receive, carry, request, or facilitate any prohibited, illegal, unsafe, counterfeit, restricted, or controlled item. This includes, without limitation:
This list is not exhaustive. ikWik may remove a listing, cancel an activity, suspend an account, retain records, or cooperate with authorities if we reasonably believe a package or activity is prohibited or presents a risk. The Sender remains responsible for all consequences, losses, fines, duties, penalties, seizures, returns, disposal costs, and claims arising from a prohibited or inaccurately declared package.
Each Sender and Traveler is independently responsible for complying with laws that apply to the shipment, route, entry, exit, and destination, including customs declarations, export and import controls, duties, taxes, permits, licenses, airline or transport-provider rules, and restrictions. Unless ikWik expressly confirms otherwise in writing, the Sender is responsible for required declarations, duties, taxes, permits, and supporting documents. Travelers remain responsible for their own travel documents, baggage, transport, and legal obligations.
Customs authorities, border agencies, airlines, transport providers, and other third parties may inspect, delay, seize, refuse, destroy, return, or charge for a package. ikWik does not control those decisions and is not responsible for resulting delays, losses, charges, or consequences.
Travelers use the Platform as independent service providers. Nothing in these Terms creates an employment, agency, partnership, franchise, fiduciary, joint-venture, or contractor relationship between a Traveler and ikWik. Travelers control whether, when, and how they travel or undertake an accepted activity, subject to applicable law and the arrangements they make with other users.
Travelers are solely responsible for their taxes, social contributions, insurance, permits, licenses, travel costs, equipment, records, and legal obligations arising from their activities and earnings. ikWik does not provide employment benefits, tax advice, immigration advice, travel insurance, cargo insurance, or legal advice.
Payments, refunds, and payouts may be facilitated by independent payment or payout providers and are subject to their terms, verification requirements, availability, and processing times. ikWik does not provide a wallet, escrow service, stored-value account, or banking service. Amounts shown in the Platform may be estimates, pending records, or transaction information and do not create a deposit, custody, or guarantee by ikWik.
Travelers may become eligible for payout only after the applicable delivery confirmation and any applicable review, hold, dispute, or compliance process. We may delay, withhold, reverse, or cancel a transaction where permitted by law or reasonably necessary to investigate fraud, a dispute, a prohibited shipment, a chargeback, or a legal or compliance issue.
Subscription plans, if offered, are subject to the displayed pricing, fair-use rules, and the Refund & Cancellation Policy.
The Refund & Cancellation Policy is incorporated into these Terms and governs cancellation, refunds, delivery failures, chargebacks, and related procedures. If there is a conflict between these Terms and that policy about a refund or cancellation, the Refund & Cancellation Policy controls for that subject.
Claims about a lost, damaged, delayed, or incomplete package must be reported promptly through customer support with the relevant delivery reference and available supporting evidence. ikWik may review Platform records, messages, tracking, delivery evidence, and information supplied by the parties, but does not guarantee a particular outcome. Any optional protection or insurance is governed solely by its separately disclosed provider terms, eligibility requirements, exclusions, limits, and claims procedure; it is not a guarantee by ikWik.
You are responsible for the information, messages, photos, documents, and other content you submit. You must not post unlawful, deceptive, threatening, harassing, discriminatory, infringing, sexually exploitative, or otherwise harmful content. You may use available reporting and blocking tools to report another user or content. ikWik may review, remove, preserve, or disclose content and account information where reasonably necessary for safety, enforcement, legal compliance, or to protect rights; however, ikWik is not obligated to monitor all user content or communications.
The Platform may rely on or link to third-party services, including payment processors, identity-verification providers, mapping providers, notification services, mobile operating systems, airlines, and transport providers. Those third parties are independent and their services, content, availability, decisions, and terms are outside ikWik’s control. Your use of third-party services is governed by their applicable terms and privacy notices. ikWik is not responsible for third-party acts, omissions, outages, fees, decisions, content, or data practices.
To the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis. ikWik disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, error-free operation, and any warranty that a shipment will be accepted, transported, delivered, timely, safe, lawful, or undamaged. Nothing in these Terms excludes a warranty, right, or liability that cannot lawfully be excluded.
To the maximum extent permitted by law, ikWik is not liable for any loss, damage, injury, delay, seizure, customs action, charge, penalty, missed connection, lost profit, loss of data, or indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to a user, package, journey, handover, delivery, third-party service, authority, or event outside ikWik’s reasonable control.
To the maximum extent permitted by law, ikWik’s total aggregate liability for a claim arising from a specific transaction will not exceed the amount actually paid to ikWik by the claimant for that transaction. This limitation does not apply where prohibited by applicable law.
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless ikWik, its affiliates, officers, directors, employees, and service providers from claims, losses, liabilities, damages, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of your account, content, package, declarations, shipment, travel, breach of these Terms, violation of law, or dispute with another user or third party.
ikWik may suspend, restrict, cancel, or terminate access to the Platform, a shipment, a payout, or an account where we reasonably believe there is a breach of these Terms, fraud, a safety concern, prohibited goods, a chargeback, a legal or compliance risk, or misuse of the Platform. Termination does not remove obligations or liabilities that arose before termination. Sections that by their nature should survive will survive, including risk allocation, limitations, indemnity, dispute, and record-retention provisions.
Our collection and use of personal data is described in the Privacy Policy. By using the Platform, you acknowledge that we may process and retain data as described there and as required by applicable law.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, except where mandatory consumer-protection law provides otherwise. Before starting a formal dispute, contact [email protected] with the relevant account or delivery reference and a clear description of the issue. We will make a reasonable effort to review the matter. Nothing in this section limits rights that cannot be waived under applicable law.
We may update these Terms to reflect changes in the Platform, law, safety, or business practices. We will post the revised Terms here and update the "Last updated" date. Where required by law, we will provide additional notice or obtain consent. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
